Terms of Use of the „Association Experiment“ App“

1. Provider and Scope
These terms of use govern the use of the application „Association Experiment“ (hereinafter „App“), provided by:

Terms: „Users“ are the professionals using the app (see Section 3). „Participants“ are the People with whom the user conducts the experiment (e.g., test subject, participant, clients, or test persons).
By downloading or using the app, the user agrees to these terms of use. The terms are made available to the user in the app store listing, within the app, and on the website (sinfothek.at/en/app-terms-of-use). 2. Purpose and scope of functions of the app
The app supports professionals in the digital implementation, documentation, and evaluation of Association experiments (AE). The experiment is based on the association experiment by C. G. Jung and can be customized and further developed in the app. The app provides, in particular, functions for structured implementation (e.g., stopwatch, read-aloud function, digital recording), for the evaluation of passages as well as ready for exporting the results.
Scope of the evaluation: The evaluation by the app is limited to recording and counting the reactions from run 1 and run 2. The final content-related interpretation of the Results and any potential diagnosis are not part of the app.
The app is a tool for conducting the experiment. It does not provide medical, psychological or therapeutic diagnosis and gives no treatment recommendations. The content Interpretation of the results is the sole responsibility of the professional using the app.
3. Target Audience and Prerequisites for Use
The app is aimed at professionals who use the association experiment in the course of their professional work Commence activity, in particular:

- Researchers
- People in education and training in this field
Use requires that the user has the necessary technical qualification to to conduct experiments and to use the results responsibly. The user must be of legal age and have full legal capacity.
4. User's Responsibility Toward Participants
The app is used under the sole responsibility of the specialist. The user is solely responsible for the relationship and the agreements with the participants of the experiment (in particular debriefing and consent). In particular, he undertakes to,
- to obtain the consents of the participants required for implementation (inter alia. informed consent, if applicable consent to data processing;
- to comply with the legal, professional, and deontological regulations applicable to their occupational group, as well as—in the case of research—research ethics requirements (e.g., approval by an ethics committee, if required);
- to adequately inform participants about the procedure, purpose, and handling of the results;
- to process the data collected during the experiment in compliance with data protection laws and – insofar as they determine the purposes and means thereof – to bear the data protection responsibility towards the participants.
The provider does not become a party to the contract with the participants and assumes no responsibility for the legal relationship between the user and the participants.
5. Data, data storage, and local processing
As of the current status, all data recorded in the app is stored exclusively locally on the device of user saved. No registration is currently required, and no content. Experimental data transmitted to the provider or to third parties.
The user is responsible for backing up this data as well as for adequate protection of their device (e.g.B. device lock) responsible. In the event of loss, defect, or reset of the device, or upon uninstallation the app can result in the irretrievable loss of locally stored data.
Device Backup and Synchronization: If the user activates device- or operating system-level backup or synchronization functions (e.g., iCloud backup, Google backup/sync), the locally stored data may be copied into the respective service by the operating system. This is beyond the provider's control and is subject to the terms of the respective service provider (e.g., Apple, Google). The user is solely responsible for configuring these functions.
Audio recordings: Voice recordings remain exclusively on the device and are not sent to the transmitted to the provider or to third parties.
Transcription (Speech to Text): The transcription (conversion of the recording into text) takes place locally on the device; the audio data does not leave the device and is not transmitted to third parties.
Read-aloud function (text-to-speech): The reading aloud of the stimulus words is done via the operating system's text-to-speech function and is designed for offline use; the voice/language used must be installed on the device. The provider has no influence on the behavior of the operating system itself.
Export function: When exporting results, the user is solely responsible for the further processing, storage, and dissemination of the exported data.
Error and Crash Analysis (Sentry): For stability and for the detection and correction of errors, the app uses the „Sentry“ service. In the process, technical diagnostic data (e.g., error and crash reports, device and operating system information, and technical identifiers) are transmitted to the service provider and processed there. Experiment or content data are not transmitted in the process. Details regarding data categories, legal basis, storage location, and retention are governed by the Privacy Policy.

6. Permitted Use
The user agrees to use the app only within the scope of applicable laws and these terms. In particular, the following is prohibited:,
- to use the app in an abusive, unlawful, or third-party rights-infringing manner;
- to decompile, reverse engineer, or manipulate the app or parts thereof, unless expressly permitted by law;
- Bypassing security mechanisms or using the app for purposes for which it is not intended.
7. Intellectual Property and Licenses
The app, its contents, design, trademarks (in particular „Sinfothek“ and „Assoziationsexperiment“ as identifiers of the app), as well as the underlying source code are protected by copyright and trademark law and remain with the provider or the respective rights holders. The source code of the app is not disclosed or licensed. The user is granted a non-exclusive, non-transferable, revocable right to use the app as intended.
The provider claims no rights to the content data recorded by the user as part of the experiment. The data protection rights of the participants (see Section 4) remain unaffected.
Third-party components: The app uses third-party software components, libraries, and packages (including open-source software). These are subject to the respective license terms of the copyright holders. An overview of the components used and the applicable licenses can be viewed within the app.
8. Warranty and Availability
The app is provided with reasonable care. However, the provider assumes no guarantee for the uninterrupted, error-free, or anytime availability and usability of the app. The provider is entitled to further develop, modify, restrict, or discontinue the app, provided this is reasonable for the user.
9. Liability
The provider shall be liable in accordance with statutory provisions for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For slight negligence, the provider shall only be liable in the event of a breach of material contractual obligations and limited to the foreseeable damage typical for the contract. Mandatory statutory liability provisions, in particular pursuant to the Product Liability Act and the Consumer Protection Act, shall remain unaffected.
The provider assumes no liability for the professional execution, the interpretation of the results, and decisions derived therefrom by the user. Likewise, the provider is not liable for the loss of locally stored or exported data.
10. Costs and future remuneration
The app is currently provided free of charge. The provider reserves the right to offer the app or individual features for a fee in whole or in part in the future.
An obligation to pay does not arise automatically and not retroactively. Before incurring any costs, the user is informed of the fee-based nature of the service and the applicable prices, and must explicitly consent to them (e.g., through a confirmation step in the app). This information and consent take place when the user begins the paid use—an advance notice period is not required. No costs are incurred without consent; however, the use of the paid features or the app will then no longer be possible.
11. Amendment of the Terms of Use
The provider may amend these terms of use, for example due to changed functions or legal requirements. Users will be informed of material changes in an appropriate manner – in particular by a notice in the app or as part of an update. Material changes or changes disadvantageous to the user (e.g., the introduction of a payment obligation) shall only become effective with the user's explicit consent. 12. Governing Law and Jurisdiction
Austrian law applies, excluding the referral norms of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the consumer's state of residence remain unaffected with respect to consumers. If the user is a business, the courts competent for the provider's registered office in Feldkirch are agreed as the place of jurisdiction.
13. Final Provisions
If individual provisions of these terms of use are or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose.
